SMS TEXT MESSAGING TERMS AND CONDITIONS

1. Program Description
RxClarity Group offers an SMS text messaging program (the 'Program') to provide you with important information about pharmacy services, including:

Appointment scheduling and reminders with our pharmacists

Pharmacy discount opportunities and medication savings alerts

Notifications about more affordable pharmacy alternatives for your prescriptions

Mail order pharmacy options for your medications

Important updates about pharmacy benefit changes and coverage
2. Opt-In and Consent
By opting into this Program, you expressly consent to receive non-automated and automated SMS text messages from RxClarity Group at the mobile phone number you provided. You understand that:

Non-automated messages make communication between you and the pharmacist more convenient regarding pharmacy care and savings opportunities.

Any-automated messages would be approved by your employer who would like you to know and have the option to take action on savings opportunities

Your consent is not a condition of purchasing any goods or services from RxClarity Group or your employer

Message frequency varies based on your interactions and program activity

Standard message and data rates may apply based on your mobile carrier's plan

You can opt-out at any time by replying STOP to any message
3. Message Frequency
You can expect to receive approximately 2-6 messages per month when you are engaged with an RxClarity pharmacist. Message frequency may vary based on your activity level, appointment schedules, and available pharmacy savings opportunities. We will not send you more than 10 messages in any calendar month.
4. How to Opt-Out
You may opt-out of the Program at any time by texting any of the following keywords to the number from which you received messages:
STOP, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, STOPALL, or OPTOUT
After you opt-out, you will receive a one-time confirmation message stating that you have been unsubscribed. You will not receive any further messages unless you opt-in again. Please allow up to 24 hours for your opt-out request to be fully processed.
If you wish to opt-in again after opting out, please text START or SUBSCRIBE to the number from which you previously received messages, or contact us using the information provided in Section 13 below.
5. Help and Support
For help or more information about the Program, text HELP or INFO to the number from which you received messages. You will receive a message with instructions on how to use the Program and contact information for customer support.

6. Message and Data Rates
Standard message and data rates may apply to each text message sent or received in connection with the Program, as determined by your mobile carrier. Please check with your mobile carrier for details about your specific plan and any applicable charges. RxClarity Group is not responsible for any charges you may incur from your mobile carrier for participating in the Program.
7. Supported Carriers
The Program is supported by major U.S. mobile carriers, including but not limited to:
AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, Cricket Wireless, MetroPCS, U.S. Cellular, Virgin Mobile, and others.
Carriers are not liable for delayed or undelivered messages. If you change mobile carriers or phone numbers, you must opt-in again to continue receiving messages.
8. Privacy and Data Collection
Your privacy is important to us. By participating in the Program, you consent to our collection, use, and disclosure of your information as described in our Privacy Policy, available at:

We may collect the following information in connection with the Program:

Information about your interactions with the Program (message history, opt-in/opt-out status)

Prescription and pharmacy information provided through your employer's benefits program to us as your employer’s contracted service provider
We do not sell, rent, or share your personal information with third parties for their marketing purposes. We may share your information with service providers who assist us in operating the Program, subject to confidentiality obligations. We implement reasonable security measures to protect your information, but no method of transmission over mobile networks is 100% secure.
9. User Obligations
By participating in the Program, you agree to:

Provide accurate and current mobile phone number information

Notify us immediately if your mobile phone number changes

Be responsible for any charges incurred for messages sent or received

Not use the Program for any unlawful purpose or in any way that violates these Terms

Understand that you are solely responsible for maintaining the security of your mobile device
10. Disclaimer and Limitation of Liability
THE PROGRAM IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. RXCLARITY GROUP MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
RxClarity Group does not guarantee:

That messages will be delivered in a timely manner or at all

The accuracy or completeness of any information provided through the Program

That the Program will be uninterrupted, secure, or error-free
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RXCLARITY GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the Program

Any unauthorized access to or use of your information

Any interruption or cessation of the Program

Any bugs, viruses, or other harmful code that may be transmitted through the Program
Mobile carriers are not liable for delayed or undelivered messages. Your mobile carrier's terms and conditions and privacy policy apply to your use of their services in connection with the Program.
11. Program Changes and Termination
RxClarity Group reserves the right to:

Modify or terminate the Program at any time, for any reason, with or without notice

Change these Terms and Conditions at any time by posting updated terms on our website

Suspend or terminate your participation in the Program if you violate these Terms

Limit the number of messages sent to you in any given time period
We will notify you of material changes to these Terms by posting a notice on our website or by sending you a text message. Your continued participation in the Program after such changes constitutes your acceptance of the new Terms.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which RxClarity Group is headquartered, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Program shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
